Foreign citizens can obtain a limited stay permit (KITAS) or
a permanent stay permit (KITAP) through sponsorship by a spouse or parent.
Eligibility
- Foreigners married to Indonesian citizens.
- Foreigners married to other foreigners who have a stay permit (KITAS or KITAP).
- Minor children of foreigners married to Indonesian citizens or other foreigners who have a KITAS or KITAP.
Benefits of Obtaining a Family or Dependent KITAS or KITAP
- Qualify for a Multiple Exit/Re-entry Permit (MERP).
- Eligible to obtain an Indonesian driver's license (Surat Izin Mengemudi/SIM).
- Permits opening bank accounts and applying for loans and credit cards in Indonesia.
- Access to discounts at tourist attractions and sports/health centers.
- Allows for a prolonged stay in Indonesia without the need for exit.
- Eligible for an Indonesian ID card (Kartu Tanda Penduduk/KTP) valid for up to 5 years (applicable only for spouse-sponsored KITAP).
KITAS and KITAP
Initially, you must obtain a family KITAS (limited stay
permit), which needs to be renewed annually for a maximum of 5 years. The KITAS
can then be converted into a KITAP (permanent stay permit). The timeframe for
conversion depends on various factors. For instance, if you are married to an
Indonesian citizen, you can apply for a KITAP after 2 years.
Process for Obtaining a Family KITAS
1. Electronic VITAS
Initially, you need to obtain an entry visa to Indonesia.
This visa is called VITAS (Visa Tinggal Terbatas). For this, you need to
provide the following documents:
For Foreigners Joining an Indonesian Spouse
- Copy of passport (with a minimum validity of 18 months).
- Copy of Indonesian spouse's ID (KTP), family card (Kartu Keluarga), and birth certificate (Akte Kelahiran).
- Marriage certificate: Akte Perkawinan (for Christian, Hindu, and Buddhist marriages in Indonesia) or Buku Nikah (for Muslim marriages in Indonesia) or Surat Tanda Bukti Lapor Perkawinan (for overseas marriages reported to Catatan Sipil).
- Proof of funds (minimum USD 1500 or equivalent; usually a bank statement).
- A photograph of the applicant against a red background.
For Dependents Joining a Foreigner in Indonesia
- Copy of sponsor's passport and KITAS or KITAP.
- Copy of dependent's passport (with a minimum validity of 18 months).
- Marriage certificate: Akte Perkawinan (for Christian, Hindu, and Buddhist marriages in Indonesia) or Buku Nikah (for Muslim marriages in Indonesia) or Surat Tanda Bukti Lapor Perkawinan (for overseas marriages reported to Catatan Sipil).
- Copy of birth certificate (for the minor children of the foreigner).
- Proof of funds (minimum USD 1500 or equivalent; usually a bank statement).
- A photograph of the applicant against a red background.
For Children Born Outside of a Mixed Marriage with an Indonesian or children of KITAS/KITAP Holders
- Copy of child's passport (with a minimum validity of 18 months).
- Copy of child's birth certificate.
- Copy of Indonesian parent's ID (KTP), family card (Kartu Keluarga), and birth certificate (Akte Kelahiran).
- Copy of foreign parent's passport and KITAS/KITAP.
- Copy of parents' marriage certificate: Akte Perkawinan (for Christian, Hindu, and Buddhist marriages in Indonesia) or Buku Nikah (for Muslim marriages in Indonesia) or Surat Tanda Bukti Lapor Perkawinan (for overseas marriages reported to Catatan Sipil).
- Proof of funds of the sponsor parent (minimum USD 1500 or equivalent; usually a bank statement).
- A photograph of the applicant against a red background.
Based on these documents, the foreigner is issued a VITAS
electronically via the internet. Visiting the embassy is not necessary. The
electronic VITAS is issued by the Directorate General of Immigration in
Jakarta, a process that takes approximately 10 working days.
2. Conversion of VITAS to KITAS
Upon arriving in Indonesia, you must visit the local
immigration office within 30 days to convert your VITAS into a KITAS. This
conversion process entails a visit to the immigration office for biometrics and
an interview. It's crucial to stay in the country during this process;
otherwise, the VITAS becomes invalid.
A few days after completing the biometrics, the immigration
office will return your passport along with the electronic KITAS.
Civil Registration and Reporting
A foreigner with a KITAS, sponsored by a spouse, must
register with the civil department within 14 days after the KITAS/KITAP
issuance by visiting the civil administration office and obtaining SKSKPS
(Certificate of Family Formation for Temporary Residents) and STM (Police
Report Certificate).
Renewal of Family KITAS
The Family KITAS is initially valid for a period of 6 months
to 1 year. Subsequently, it must be renewed every 6 or 12 months, with a total
validity of up to 5 years. It's important to note that the validity of the
dependent's KITAS is equivalent to the validity of the sponsor's KITAS.
Termination of Spouse KITAS
The spouse KITAS can be terminated in the following cases:
- The foreigner does not return to Indonesia for more than a year after departure.
- The foreigner divorces or their Indonesian spouse dies before reaching 10 years of marriage.
- The foreigner holding a KITAP fails to report to immigration every five years.
- The foreigner acquires Indonesian citizenship.
- The spouse's visa is cancelled by the Indonesian government due to special circumstances.
